Assessing the British Proposal on Space Security - The Diplomat, 10 December 2020

In my column for The Diplomat last week, I looked at the recent UK proposal on space security governance.  That the UK proposal emphasizes a bottom-up approach and stresses trust-building are important.  It is a critical first step.  

Space security issues have potentially serious consequences. The consequences of either a deliberate or even an accidental conflict in space are too horrible to contemplate. A day without the utility provided by outer space is difficult to even conceive and yet the actions of states might lead the world in that direction sooner than later. Unless states take measures to restrain some kinds of activities in space, access to space will not be safe, secure, or guaranteed.

Because of the highly competitive and contested nature of major power relations today, even peaceful applications and technological developments such as On-Orbit Satellite Servicing or technologies to tackle space debris are viewed with much suspicion. There are also more specific space security threats – the return of anti-satellite (ASAT) testing, and cyber and electronic warfare in space, for example. Any satellite service disruption or damage will have a wide-ranging impact, one that cannot be contained to the security or economic sectors alone, and one that cannot be limited geographically either given the significant global dependence on space. Space is truly a global commons. 

All of this suggests we need new rules of the road. There have been recent efforts including the Russia-China sponsored draft Treaty on the Prevention of the Placement of Weapons in Outer Space, the Threat or Use of Force against Outer Space Objects (PPWT), originally proposed in 2008 (with a revised text introduced in 2014); the 2010 EU-initiated International Code of Conduct for Outer Space Activities (ICoC), the U.N. Group of Governmental Experts (GGE) on transparency and confidence building measures (TCBMs) in 2013, and the 2018-19 GGE on further practical measures for the prevention of an arms race in outer space (PAROS). None of these have led to a favorable conclusion.  

The biggest challenge facing the development of an outer space regime is a lack of consensus among major powers. These are essentially political impediments and therefore that much harder to overcome than practical issues. Major power relations are characterized by a serious lack of trust and confidence in each other. And therefore, what we need in the first instance are measures that would strengthen confidence.  

The United Kingdom has also made a recent proposal — “Reducing Space Threats through Norms, Rules and Principles of Responsible Behaviors” — aimed at looking at problems in space through a bottom-up approach. The proposal, in one of its operational clauses:

encourages Member States to study existing and potential threats and security risks to space systems, including those arising from actions, activities or systems in outer space or on Earth, characterize actions and activities that could be considered responsible, irresponsible or threatening and their potential impact on international security, and share their ideas on the further development and implementation of norms, rules and principles of responsible behaviors and on the reduction of the risks of misunderstanding and miscalculations with respect to outer space.

It further calls on the U.N. secretary general to get views from member states in a substantive report to be submitted to the General Assembly at the 76th session scheduled for September 2021 for additional discussion. The plan is to include this in the provisional agenda of the General Assembly’s session, under the item, “Prevention of an arms race in outer space,” with a sub-item entitled, “Reducing space threats through norms, rules and principles of responsible behaviors.” 

One of the key features of the U.K. proposal is to focus on a behavior-based approach, since debates focused on an object-based approach have not gone very far. The U.K. proposal is not prescriptive in suggesting a particular type of outcome or a particular format. Thus, this proposal provides room for greater flexibility and certain amount of maneuvering among member states as they debate the threats and challenges and possible ways forward. 

Even though there is no particular preference for a specific format as an outcome, it is important to look at this as a process that would lay stress on trust-building as a key driver. Given the high level of disagreements among major space powers, this is a sensible approach. In this regard, transparency and confidence building measures (TCBMs) offer a good first step between recognizing the functional need of regulating space and the negotiation of a binding instrument. There has been any number of debates on the need for and effectiveness of binding and non-binding instruments, but these discussions have not led to any meaningful outcome. TCBMs are certainly not a substitute for legal measures but they can be effective tools in bringing about openness, transparency, and information sharing, which are badly required to raise the level of political confidence between key great powers. TCBMs are essentially a bridge that can provide opportunities for countries to talk to each other and work on building greater trust in each other. This is a recognition that political issues have become the biggest hindrance in developing new rules of the road for outer space activities. 

A few measures that could be considered in this regard include pre-launch notifications (already contained in the Hague Code of Conduct against Ballistic Missile Proliferation) and ASAT test guidelines and rules for intentional orbital breakups. Others include the UNIDIR proposal (no debris, low debris, and notification) and pledges like “Not the First to Act beyond the scope of Article 51” because many developing countries worry that the right to self-defense under U.N. Charter Article 51 may be used as an excuse for space weaponization. 

While an end goal of developing more binding agreements for space security must be pursued, reaching a political consensus to commit to legal instruments appears to be difficult in today’s political and security environment. Revising or reforming the 1967 Outer Space Treaty is problematic precisely due to the current political impediments. Therefore, states need to first invest a great deal in developing mutual trust. The U.K. proposal provides an alternative to the PPWT or the EU ICoC, both of which have run into their own problems. The bottom-up approach emphasized in the U.K. proposal, letting member states to identify threats and challenges from their national security perspectives, is a welcome step.

Russian ASAT Test: More Trouble for Space Security - The Diplomat, 31 July 2020

In this week's column for The Diplomat, I looked at the recent Russian ASAT test and what it means for space security. I argue that even as the war of words continues, there will need to be practical measures to deal with the increasing threats to space.


On July 23, the U.S. Space Command (USSPACECOM) released a statement saying that Russia had “conducted a non-destructive test of a space-based anti-satellite weapon.” According to the statement, Russia, on July 15 “injected a new object into orbit from Cosmos 2543” in close proximity to another Russia satellite. This reportedly is similar to a prior Russian in-orbit activity undertaken in 2017. The latest Russian action also comes against the backdrop of a Russian anti-satellite test in April, when it fired a missile into space. Although Russia did not destroy any target during this test, the April test along with the July one raises doubts about Russia’s rhetoric of non-weaponization of space.

If these activities continue unabated, it will only further intensify competition among the major space players, potentially leading to weaponizing space. The space security regime is already in trouble; the Russian test creates additional problems. The experience of the UN Group of Governmental Experts (GGE) on Prevention of Arms Race in Outer Space (PAROS) is a reflection of the current poor state of dealing with issues of global space governance. The failure of the major space powers to address space security challenges and agree upon a future path will be detrimental to maintaining space as a safe, secure, and sustainable domain.

This is not the first time that Russia has undertaken such an action. In 2017, the Russian “inspector” satellite Cosmos 2519 released a subsatellite, Cosmos 2521. The United States has been direct and harsh in its criticism of Russia. Well before the July tests, U.S. Assistant Secretary of State Christopher Ford categorically characterized Russian actions thus: “Not to put too fine a point on it, but Cosmos 2521 demonstrated the ability to position itself near another satellite and fire a projectile” (italics in original). Quoting Gen. John W. “Jay” Raymond, commander of USSPACECOM, Ford explained that the U.S. has specific concerns because Russia has repeatedly demonstrated its capabilities in this regard. Apparently, there were two other Russian satellites, Cosmos 2542 and 2543, that were launched by Russia in November and December 2019 and these have undertaken maneuvers close to a U.S. satellite in low earth orbit. The United States views these actions, Ford said, as “highly provocative.”

U.S. criticism became even sharper after the July 23 Russian test. Raymond noted that “the United States, in coordination with our allies, is ready and committed to deterring aggression and defending the nation, our allies and vital U.S. interests from hostile acts in space.” Ford said that this action “highlights Russia’s hypocritical advocacy of outer space arms control, with which Moscow aims to restrict the capabilities of the United States while clearly having no intention of halting its own counterspace program — both ground-based anti-satellite capabilities and what would appear to be actual in-orbit anti-satellite weaponry.”

Meanwhile, Russia has rejected the U.S. claims as “propaganda.” The Russian Foreign Ministry argued that the test “did not create a threat for other space equipment and most importantly, did not breach any norms or principles of international law.” Kremlin spokesperson Dmitry Peskov also dismissed the U.S. claims, saying that “Russia has always been and remains a country that is committed to the goal of fully demilitarizing outer space and non-deployment of any kinds of arms in outer space.”

It has to be noted that Russia has been trying to push initiatives to prevent weaponization of space for some time. Russia, along with China, has been calling for a treaty banning the placement of weapons in outer space. In 2008, the two together submitted a draft Treaty on the Prevention of the Placement of Weapons in Outer Space, the Threat or Use of Force Against Outer Space Objects (PPWT). A revised text was submitted in the summer of 2014. A second Russian proposal is that of the “No First Placement” initiative, in which countries are expected to voluntarily agree not to be the first to place weapons in outer space.

Neither of these proposals have found many takers for a number of reasons. First, many countries argue against a treaty-based mechanism in the current international political climate. They would instead prefer political instruments such as transparency and confidence building measures (TCBMs) or a code of conduct, all of which are non-legal instruments. But other countries argue that while non-legal measures can be useful, they cannot be a substitute for legal instruments. Second, there are also practical issues such as the definition of a “weapon” in space. In the absence of definitional clarity, it is likely to be difficult to come up with a mechanism to prevent the placement of weapon in outer space.

While there is merit to both these arguments, the reality is also that unless steps are taken to improve transparency and predictability with regard to outer space activities, states will likely find themselves spiraling toward weaponizing outer space.

Even as the war of words continues, there will need to be practical measures to deal with the increasing threats to space. We are witnessing a number of escalatory actions including ASAT tests, cyber and electronic warfare targeted at space assets, and now what appears to be an actual kinetic weapon in space. Unless decisive steps are agreed upon by the major space players, access to space for civil and peaceful as well as security requirements will be harmed. While formal treaty mechanisms have been favored previously, today’s contentious global politics may not allow for such measures in the near term. These trends are of course dictated by global power transition leading to a new and competitive geopolitics. Therefore, expecting to develop a legal measure in the near term will remain difficult. Finding alternate approaches, such as developing norms of responsible behavior, may be a better path.

Managing New Actors in the Space Domain - The Diplomat, June 29, 2019

In this week's column for The Diplomat, I looked at the new actors in outer space and what it means for the global governance and space sustainability issues. I argue new entrants in the Indo-Pacific offer both opportunities and challenges for the outer space realm.


New actors in space is a tricky idea to define. Is it determined by the number of years a player has been in the space business, or something more nuanced? If one is talking about industry and the commercial sector, it is relatively easy to categorize and identify who is a new actor in space. But when it comes to states, what determines who is a new space actor is slightly more problematic.

Surely, those emerging states that are pursuing space programs can be called new actors in space. Nevertheless, one must push the envelope further to look at who the traditional players are, and these are the United States, Russia, and Europe. Therefore, even countries like India and China and others who have pursued space programs for a few decades now can be called new actors in space. This is the case because one is beginning to see new facets of their space programs which are affecting space security and sustainability dynamics.

But the space domain is changing. It is not just the presence of new start-up companies that are altering the space landscape, but there are any number of new state actors that are pursuing space programs for a number of different functions and utilities. This has been possible because there has been certain amount of democratization of space with access to space becoming a lot more affordable. Costs are coming down, technological hurdles are lower, and new space collaboration and partnerships driven by geopolitical goals are introducing new players in space. These make it possible for a growing number of actors to pursue space programs. Many states in Africa, Latin America, and particularly Asia are pursuing space programs for a variety of different utilities including for national security applications.

Entry of new actors in space bring both opportunities and challenges. On the opportunity side, space has become more accessible to a large number of states due to innovation in technology and dilution of certain global export control regulations. The development benefits alone of this are huge. There is a great opportunity here, for both private sector and for others, to collaborate with these new actors because they are looking for efficient, cheap, flexible solutions (such as in communications, or in weather forecasting or in remote-sensing applications for land use etc) rather than simply prestige projects.

New private actors bring new energy, new ideas, possibly a more efficient way of doing things. Of course, when private corporations get involved, some part of the social needs that governments focus on can be lost, obviously, since private actors are less likely to focus on development issues or on non-profit ventures. Even here, though, we need to acknowledge the general contribution made by these new entities in terms of the technologies they develop, which will have a broader impact, and make space more accessible.

Also, it is important to see what kind of partnerships can be fostered to make space accessible to all. Partnerships between private sector and national programs will be a good burden-sharing arrangement. This kind of public-private sector partnership has worked in the Western context with a lot more ease, but in the Asian context, it has not been easy. We see a bit of it, but established government space agencies tend to be suspicious of new private actors, such as in India. Another problem might be the kind of areas that private sector is involved, whether there are only areas servicing expensive, well-heeled customers (such as space tourism) or whether they are also looking at things that benefit smaller, poorer countries.

The entry of new actors in space has brought certain risks as well. One major risk is related to the impact on norms of behavior. With more actors in space, there has been a dilution of some of the existing norms and the new players appear to be less willing to play by rules developed by others. For instance, the norm of not testing anti-satellite (ASAT) missiles that prevailed for decades appear to be weakening. More importantly, the norm of not interfering in each other’s space assets appear to be getting diluted even further with the growth in cyber and electronic warfare in outer space.

The established players who have shaped these norms appear less likely to break those norms as compared to new players who are less bound by them. Newer players possibly assume that these norms are a way of restricting their growth and therefore they are less likely to play by them. Additionally, the spread of technology and geopolitical competition have aided this dilution of norms.

Therefore, as new players emerge in space, one of the critical areas to focus on is to strengthen the rules of the road, in a number of different ways. These could include establishing or reinforcing norms of responsible behavior, developing TCBMs and codes of conduct. These are the required first steps before establishing legal mechanisms because of the political difficulties that have come in the way of making new legal frameworks for outer space.

Rule-making was an easier exercise when there were fewer actors, obviously. Today, with close to 80 actors including non-state and new actors in space, finding an agreement and developing consensus has become a significant challenge. Finding an avenue to bring in the commercial voice is also important but traditional venues such as the Conference on Disarmament (CD), where space security and arms control issues are debated, are opposed to the introduction of commercial players as a stakeholder in their debates. This is not to suggest that commercial perspectives cannot be brought in through governments. But involving commercial players as independent actors in CD-like venues is not likely to happen in the near future.

Clearly, politics in outer space is getting complicated. It needs far more concerted attention than it has received. It may not be too late yet, but time is running out.

The Case for Outer Space Cooperation in South Asia - 18 January 2018

In this week's column for The Diplomat, I published a piece making a case for outer space cooperation in South Asia. The piece, "The Case for Outer Space Cooperation in South Asia," I argue that while the need for cooperation is clear, realizing such cooperation will mean addressing several key challenges, including those among the established space powers in the region.


Space technology has great potential to help social and economic development, especially in parts of the developing world such as South Asia. Yet, South Asia has not fully exploited the space domain for several reasons. Availability of resources and lack of visionary leadership in the region are important factors, but so are international insecurity and conflict. While there are limitations in dealing with the former set of issues, it is possible to suggest some ways to deal with the latter set.

In particular, confidence building measures (CBMs) can help promote space development in South Asia. This has been a theme of many workshops and seminars in the last couple of years. The author has participated in several such engagements where representatives of some of the smaller countries in the region have shown pronounced interest in international collaboration in developing outer space assets and technologies for meeting developmental challenges. But these countries also feel they are caught in the accelerating competition between India and China, which spills over into this domain too.




There is little doubt about the demand side: South Asia is a region with uneven development and serious social, economic, and developmental challenges. Space technology capabilities are also unevenly spread with China and India as established space players in the region but with more new entrants in the field. Countries like Bangladesh, Sri Lanka, Nepal, and the Maldives have a clear requirement for space capabilities for a number of different utilities such as dealing with natural disasters and communication. The region has remained prone to many weather-related calamities on a fairly frequent basis, making disaster warning and mitigation important drivers for pursuing an outer space agenda.

Strengthening connectivity, communication, and broadband internet across rural and remote areas of the region too should be strong imperatives. India and China can offer significant assistance to these new entrants. But at the same time, smaller countries worry about being dragged into the Sino-Indian competition if they collaborate with one side or the other.

Another factor to keep in mind is the poverty of existing rules and norms for outer space. Treaties such as the Outer Space Treaty (OST) are increasingly inadequate to deal with the rapidly developing space sector. This has resulted in a growing debate about how to strengthen space norms and rules to ensure safe and sustainable use of outer space for future generations.

But in developing new rules, care must be taken to ensure that, without restricting legitimate cooperation between states in outer space, there are adequate safeguards to prevent completely unregulated outer space cooperation that could lead to greater insecurities for some or all. Among the smaller countries, Sri Lanka has taken active interest in the past and in going forward with such efforts.

More international cooperation and coordination is definitely needed. In the Indo-Pacific region, there are two major regional space cooperation initiatives, one each under Japan’s and China’s leadership. Most South Asian countries are members of the Asia-Pacific Regional Space Agency Forum (APRSAF) that is governed by Japan. Pakistan and Bangladesh are members of both the APRSAF and Asia-Pacific Space Cooperation Organization (APSCO), the Chinese initiative in the region.

Yet, the big lacuna is that these two initiatives do not collaborate in any manner whatsoever. The limited resources of the many new space players could be more judiciously used if there were a means to get the two initiatives to work together. For example, there could be joint initiatives in the area of manufacturing and launching satellites for the purpose of providing advance weather-related disaster warning.

More significantly, space cooperation at the regional level has to focus on more basic needs. Regional powers can join hands in providing sounding rockets, to start with, and weather satellites, for instance. Areas such as disaster warning and mitigation are ideal candidates for cooperation within the South and Southeast Asian regions.

But there is also potential for cooperation at the higher end of the spectrum. Strengthening cooperation in Space Situational Awareness (SSA) and enhancing SSA coverage in the southern hemisphere can be an important aspect of cooperation among the more capable space powers in the region. India, China, and Japan have their own limited capabilities to monitor the space environment. Combining the efforts of these three large spacefaring powers in Asia would be greatly beneficial. And if the bigger space players in Asia could find ways to cooperate, it would provide incentives to smaller states as well.

Space should be playground for humanity’s dreams, not new battlefield

Here's a short essay of mine on the global governance of outer space published by the Global Times on October 09, 2013. As two of the established space powers in Asia, India and China, have a responsibility in framing the evolving rules by rectifying loopholes. Legally binding mechanisms are ideal and desirable. However, the prospect of consensus among major powers in identifying challenges and introducing solutions seems distant.

Given these difficulties, India and China could start working toward common definitions of responsible behavior and greater transparency measures among major powers.

With the growing dependence on outer space assets for socioeconomic, developmental and military purposes, the number of players in outer space is growing rapidly. There are more than 60 such operators, including non-state actors, in this domain.

India and China, as two of the established space powers in Asia, have a responsibility in framing the evolving rules by rectifying loopholes.

Legally binding mechanisms are ideal and desirable. However, the prospect of consensus among major powers in identifying challenges and introducing solutions seems distant.

Given these difficulties, India and China could start working toward common definitions of responsible behavior and greater transparency measures among major powers.

A new regime should be guided by three key objectives: the security of outer space, order and stability, and sustainability. Most nations accept and acknowledge these objectives, at least rhetorically.

India and China face several common challenges. Operationally, these include space traffic management, overcrowding of satellites and debris in outer space. The debris increases the potential of collision with currently viable assets.

For example this May, the only Ecuadorian satellite, Pegasus, collided with Russian space debris and on August 28, it was officially declared "lost." The UN Inter-Agency Space Debris Coordination Committee predicted that space debris, unless tackled aggressively, will have grave consequences over the next 200 years.

The ongoing militarization of space is a concern. Several countries are using space assets for military functions, developing anti-satellite capabilities and offensive uses for space assets, and are making the threat of weaponization and a new arms race imminent.

With this congestion, the need for cooperative rules and regulation cannot be overemphasized, possibly through an institution similar to the Nuclear Suppliers Group.

Unregulated cooperation will only heighten insecurities at multiple levels. This explains the inadequacy of the current regime which has been hobbled by political differences and precluded a new cooperative architecture.

Consequently, different countries have been pursuing tangential solutions. The West has by and large favored Transparency and Confidence Building Measures (TCBMs) as a means to develop norms of responsible behavior in order to ensure safe, secure and continued access to space. While Russia accepts TCBMs, it has joined hands with Beijing to propose a draft treaty preventing the placement of weapons in outer space.

Similarly, a resolution on the Prevention of an Arms Race in Outer Space (PAROS) was passed by the UN General Assembly in 1981, but the Conference on Disarmament (CD) in Geneva is yet to have a productive session on PAROS.

The UN Group of Governmental Experts (GGE) is another mechanism to develop cooperative measures in outer space. India too has been active in writing new rules. With a consistent policy against the weaponization of space, it has been active in forums like the UN Committee on the Peaceful Uses of Outer Space and the CD.

Even as it insists on working out a legally binding mechanism, it is pragmatic enough to recognize the need to start with a normative exercise and gradually move to legal measures.

Space, as a true global commons, must be protected for safe, secure and uninterrupted access. India and China, along with other spacefaring powers, must therefore utilize every opportunity to push for developing norms of responsible behavior, including strengthening measures in the area of active debris removal and on-orbit satellite servicing.

These two early space powers should take on an active role in bridging the gap between the West and the rest in formulating new rules including the Space Code of Conduct and should not allow a few Western countries to monopolize the process, given the huge financial stakes involved.

TCBMs: A New Definition and New Role for Outer Space Security

Frank A. Rose, Deputy Assistant Secretary, Bureau of Arms Control, Verification and Compliance for the United States Department of State, recently participated as a panelist in “Defining Space Security for the 21st Century.” The panel, which convened on June 13, 2011, was part of the Space Security Through the Transatlantic Partnership Conference sponsored by the European Space Policy Institute and Prague Security Studies Institute, held June 12-14.

In his remarks, Mr. Rose discussed the diplomatic activities being pursued by the United States to enhance stability in outer space and as result its security. Specifically, Mr. Rose limited his remarks to the policy tools that the United States is considering, if not already using, to advance and to promote security and stability in outer space with an emphasis on the use of transparency and confidence-building measures (TCBMs). Mr. Rose noted the United States’ use of TCBMs through USSTRATCOM’s Joint Space Operations Center (JSpOC) and its provision of notifications to the Russian Federation and the Peoples’ Republic of China regarding close approaches between satellites.

Mr. Rose also remarked that the United States is considering signing on to the European Code of Conduct for Outer Space Activities (CoC) as part of its policy to strengthen stability and security in outer space. Mr. Rose further commented that the United States will be participating in the Group of Government Experts on Outer Space TCBMs in 2012. The Group of Government Experts, which was established by Resolutions 65/68 during the 65th session of the United Nations General Assembly, is anticipated by the United States to serve as a positive mechanism to examine voluntary and pragmatic TCBMs in space to remedy concrete problems presented in space stability and security. Ironically, or perhaps by design, Mr. Rose’s remarks concerning the use of TCBMs come one week after Huang Huikang, director of the Department of Treaty and Law in the Ministry of Foreign Affairs for the Peoples’ Republic of China addressed the 54th session of United Nations Committee on the Peaceful Uses of Outer Space (COPUOS) on June 5th, where he spoke about China’s space policy. In his address, he noted the importance of space law as an important instrument for safeguarding the peaceful use of outer space.

While not mentioning the PRC’s defense policy or the PPWT in particular, Huang also noted that space law is important for the prevention of the weaponization of space, thus intimating that space stability and security can be achieved only through an expansion of the current legal regime for outer space. The approach of the United States policy and that of the PRC towards space stability are diametrically opposite and should provide an interesting dichotomy when the Group of Government Experts meets next year to consider the role of TCBMs should play in space activities.

Transparency and Confidence-Building Measures
Transparency and confidence-building measures (TCBMs) are part of the legal and institutional framework supporting military threat reductions and confidence-building among nations. They have been recognized by the United Nations as mechanisms that offer transparency, assurances and mutual understanding amongst states and they are intended to reduce misunderstandings and tensions. They also promote a favorable climate for effective and mutually acceptable paths to arms reductions and non-proliferation. The General Assembly at its 73rd plenary meeting on December 7, 1988 endorsed the guidelines for TCBMs decided upon by the Commission on Disarmament on December 12, 1984.

TCBMs have been used extensively for the purpose of arms control and specifically in the arena of nuclear weapons. However, when applied to space activities TCBMs can address other space activities outside of those performed for by the military or for those performed for national security reasons. While TCBMs promote transparency and assurance between states, they do not have the legal force of treaties and states entering into them are bound only by a code of honor to abide by the terms of the instrument. By their nature TCBMs are considered a “top-down” approach to addressing issues. They are not intended to supplant disarmament accords but rather to be a stepping stone to legally enforceable instruments.

Redefining TCBMs for outer space activities
TCBMs as envisioned by the United States provide the Obama Administration with a diplomatic and policy tool that it can utilize to unilaterally project its foreign policy agenda without interference from Congress and in particular the Senate. With the loss of the majority in the House of Representatives and a greatly diminished majority in the Senate, the Obama Administration is faced with a less than favorable political environment to propose a treaty such as the PPWT. TCBMs give the Administration an alternative to side-step political impediments to pursue its foreign policy objectives in place of an actual treaty in regards to outer space stability and security.The position set forth by the United States regarding the use of TCBMs does not coincide with the traditional view and use of TCBMs. Per the National Space Policy, the United States is seeking to enter into TCBMs to define space activity and conduct as an alternative to entering into legally binding treaties.

This approach to TCBMs was articulated by Paula Desutter when discussing the implications of the United States signing onto the CoC. Ms. Desutter remarked that the CoC was preferable to the draft Treaty on the Prevention of the Placement of Weapons in Outer Space, the Threat or Use of Force against Outer Space Objects (PPWT) proposed by the Russian Federation and the Peoples’ Republic of China. She noted that the CoC could provide an alternative approach and vehicle to ensuring space security and stability that could undermine or ultimately lead to the demise of the PPWT. If this is the tack that the United States intends to take at next year’s meeting of the Group of Government Experts, then it will meet opposition from several constituencies.

The PRC and the Russian Federation will certainly oppose as they have in the past any form of TCBMs that are not linked to some sort of arms control agreement such as the proposed PPWT. The Russian Federation in particular has noted that TCBMs have been used in the past to address issues relating to space activities, and that it has used unilateral TCBMs itself in regards to notifications of launches and the pledge not to be the first to deploy space weapons. The Russian Federation has stated it will likely continue to support the use of TCBMs to lay the ground work for adoption of the PPWT and that the adoption of the PPWT would be the most important confidence-building measure in outer space.

If reaction by Asia-Pacific nations to the proposed CoC is any indicator, the United States could also find opposition from other space-faring nations in that region. Open-source material criticizing the CoC suggests that India might object to the United States’ approach to space security and stability. Dr. Rajeswari Pillai Rajagopalan’s, a Senior Fellow in Security Studies at the Observer Research Foundation remarked on whether India should endorse the CoC. Dr. Rajagopalan notes in her critique of the CoC that the European Council did not consult Asian nations while drafting the instrument, and that while the Coc is voluntary, its mandate for states to establish national policies and procedures to mitigate the potential for accidents in space could be seen as intrusive. She further critiqued that the voluntary nature of the CoC would preclude any penalty on states violating the norms within. Similarly, some of the concerns voiced by Dr. Rajagopalan could be expressed by India and other nations within the Asia-Pacific region concerning the use of TCBMs with the most prominent being their lack of enforceability and verification.
The United States will also find opposition from the non-space faring nations. The United States is portrayed as the neighborhood bully when it comes to matters of international security, especially in the realm of outer space security, and the realities of soft politics will ensure that will not change anytime soon. Attempts to address the issue of space security and stability via TCBMs as proposed by the United States will be met with suspicion by non-space faring nations and the delegation from the PRC and Russian Federation will likely stoke that dissension.

Conclusion
The use of TCBMs in place of treaties may not be the ideal diplomatic solution to deal with the issue of space security and stability. However, until such time that a reliably verifiable and workable treaty is introduced that can pass Congressional muster, the use of TCBMs are a prudent course for the United States to take to address the issue of stability and security in outer space while simultaneously preserving its national security interests in that realm. Only time will tell whether this approach will ultimately be embraced or rejected by space faring and non-space faring nations alike.
